Welcome to Field Proof ("App," "Service," "we," "us," or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms and Conditions.
1.Acceptance of Terms
By accessing or using Field Proof, you acknowledge that you have read, understood, and agree to these Terms and Conditions. If you do not agree, do not use the App.
2.Description of Service
Field Proof is a software application designed to assist users with property inspections, documentation, image analysis, and report generation. The App is intended as an informational and productivity tool only.
3.No Professional Advice
Field Proof does not provide legal, engineering, architectural, code enforcement, or professional inspection services. Any inspection findings, code references, recommendations, or reports generated by the App are provided for informational purposes only and must be independently reviewed and verified by a qualified professional before reliance or use. Users are solely responsible for all decisions and actions taken based on information provided by the App.
4.User Accounts
- •You are responsible for maintaining the confidentiality of your account credentials.
- •You agree to provide accurate information and to promptly update any changes.
- •You are responsible for all activity that occurs under your account.
5.User Content
- •You retain ownership of photographs, reports, notes, and other content uploaded to the App.
- •By uploading content, you grant Field Proof a limited license to store, process, analyze, and display such content solely for purposes of operating and improving the Service.
- •You represent that you have the legal right to upload any content submitted through the App.
6.Artificial Intelligence and Automated Analysis
- •Field Proof may utilize artificial intelligence and automated analysis tools.
- •AI-generated results may contain inaccuracies, omissions, or errors.
- •Users must independently verify all findings before relying upon them.
- •Field Proof makes no guarantee regarding the accuracy, completeness, or suitability of AI-generated outputs.
7.Privacy
Your use of the App is subject to our Privacy Policy, which is incorporated into these Terms by reference.
8.Prohibited Uses
You agree not to:
- •Use the App for unlawful purposes.
- •Upload malicious software or harmful content.
- •Attempt to reverse engineer or disrupt the Service.
- •Access accounts or data belonging to others without authorization.
- •Use the App in a manner that violates applicable laws or regulations.
9.Intellectual Property
The App, including its software, logos, branding, and proprietary features, is owned by Field Proof and protected by intellectual property laws. No rights are granted except as expressly provided in these Terms.
10.Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE." FIELD PROOF DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND RELIABILITY.
11.Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIELD PROOF SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. FIELD PROOF'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT PAID BY THE USER FOR THE SERVICE DURING THE TWELVE MONTHS PRECEDING THE CLAIM.
12.Indemnification
You agree to indemnify and hold harmless Field Proof, its owners, employees, contractors, and affiliates from any claims, damages, liabilities, or expenses arising from your use of the App or violation of these Terms.
13.Modifications
We reserve the right to modify these Terms at any time. Updated versions will be posted within the App. Continued use constitutes acceptance of revised Terms.
14.Termination
We may suspend or terminate access to the App at our discretion for violations of these Terms or for operational reasons.
15.Governing Law
These Terms shall be governed by the laws of the State of North Carolina, without regard to conflict-of-law principles.
